COMMUNITY COMPLAINTS ARE IGNORED

Below are various communications and a press release from City Councilwoman Kymberly Pine's office, and her aid, Louis Galdeira, regarding complaints received from the community. In August, after DPP responded to the first complaint, nothing more was done. Basically, after a few questions, Kymberly Pine thought everything was OK. Now, after all the problems have been exposed, she is
calling for investigations and asking for the dredged material to be shipped back to Hawaii Kai. Also see below links to news media articles about her "saving the day". But, did she, especially after ignoring the original complaints?

Councilmember Pine Demands Debris be Returned to Hawaii Kai
(HONOLULU)
— Responding
to community concerns that tons of sludge is being dredged from the
Hawaii Kai Marina and dumped in Waianae, Councilmember Kymberly Marcos
Pine is demanding that the Hawaii Kai Community Association remove all
of the debris and return it to holding areas in
Hawaii Kai.
The City has cited
SER
Trucking, which was hired to truck and store the materials, for not
having a proper grading permit. However, Councilmember Pine does not
believe this is enough to stop the potentially illegal
dumping.
“I
will make sure that I do everything in my power, including exploring
all legislative options to stop this private marina from dumping its
sludge in our community and ensure that this unchecked dumping never
happens again,” Councilmember Pine said.
Waianae
residents are upset that the sludge is being dumped in their community
and expressed their concerns. Responding to the community, Robert
Clark, president of the Hawaii Kai Marina Community Association
referred to Waianae residents’ concerns as “total ignorance,”
saying, “if they were aware of what that material was, they would say please let me have more of it,"
(Hawaii News Now).
Councilmember
Pine also responded to Mr. Robert Clark’s statements today, saying “I
take great offense to Mr. Clark’s statement and demand that
he apologize to the people of Waianae for his comments.”
Councilmember
Pine represents residents of District One (Ewa, Ewa Beach, Kapolei,
Honokai Hale, Ko Olina, Nanakuli, Maili, Waianae, Makaha,
Keaau, Makua) and chairs the Intergovernmental Affairs and Human
Services Committee.

Here is a synopsis of the response from Department of Planning and Permitting regarding TMK 8-5-004-:004.
“DPP inspectors have conducted an investigation and are working with the lessee (Mrs. Silva) with becoming compliant with the Oahu
Soil and Water Conservation District Plan, which is required for an
agricultural exclusion from the City’s Grading Ordinance. The inspectors
will continue to do follow up inspections and enforcement. According to
the lessee the soil is for farming purposes. The lessee was informed
about the need to install appropriate best management practices to
contain potential runoff from the work area. Please be assured that DPP
will continue to monitor the situation and take the appropriate action
as necessary when the investigation is completed. Mahalo for your

cc’d both neighborhood board chairs as I understand the issue was
mentioned at the Nanakuli NBM and the property is located in the Waianae
district. I bcc’d those in the previous email trail…

Can you folks help me in finding out what's going on at TMK 85004004, belonging to Sandra Silva? This land is adjacent to Hawaiian Home Lands, TMK 85004041,
Kaupuni Stream, Wai'anae Valley Homestead.
We've
recently noticed that they are disposing of gray sludge/dirt on this
property. They are building a berm and this would be disastrous to our
environment if it were to flow makai due to massive rainfall or a storm.
Even if it isn't in the "stream bed" is this being monitored and
permitted?
In
the past, there were allegations that illegal dumping had occurred in
Wai'anae Valley. I don't recall if an investigation occurred because I
don't recollect a formal report or outcome. Maybe I missed it, it
wasn't substantiated due to the lack of evidence or it didn't occur... I
don't know.
However, I'd
like this inquiry to be investigated and responded to in a formal
response/report for community's review/distribution. I don't know
what/who/how to pursue this matter further, but I'm available to assist
where possible. I've pulled up some basic C&C TMK & DPP website
info and some Google Maps aerial views of the area. In addition, I
also took several pictures yesterday and this morning from Kaupuni Park.
This morning, I saw two separate trucks dumping their loads. I followed them down WV Road
and also got their license plates. Although, I didn't get the trucking
company's name, I'm sure someone in the trucking business will
recognize these nice blue trucks with yellow & orange stripes.
